Examination of Proposed Settlement Offer by Roundup Cancer Sufferers

The proposed settlement offer made by Bayer AG is under heavy scrutiny from Roundup cancer victims. A news report disclosed that the plaintiffs in a mass tort claim against the company called on a federal judge to reject the proposed settlement.

The contentious settlement aims to allow Bayer to continue selling the herbicide while limiting legal options for individuals diagnosed with cancer in the future. The report further disclosed that the call for rejection is one of the many requests brought before the U.S. District Court Judge Vince Chhabria on Wednesday, May 19th.

The main contention is that the proposed settlement, among other things, requires healthy individuals who are already exposed to Roundup to relinquish their right to sue if later diagnosed with non-Hodgkins lymphoma. It would also limit the legal option of people exposed to Roundup chemical glyphosate in the future and get sick.

While commenting on the proposal, Judge Chhabria said that the concept Bayer is relying on only applies when a company decides to pull a harmful product from the market or put a warning label on it. The over 4,000 plaintiffs affected by Roundup are optimistic that the court would rule in their favor.

The plaintiffs also hope to get a trial by jury and are resolute to keep fighting against the unfair proposal. The case remains in the U.S. District Court for the Northern District of California. Judge Chhabria is expected to make a ruling on it at a later date.
