Larry Patterson received a Covidien Symbotex hernia mesh implant in 2017. His case was the first bellwether trial to go before a jury out of roughly 10,350 plaintiffs nationally pursuing claims against Medtronic over its Parietex, ProGrip, and Symbotex hernia mesh lines.
The mesh’s absorbable collagen barrier dissolved far faster than represented, causing the underlying polyester mesh to adhere to his bowel and leading to a bowel obstruction requiring major surgery, including a bowel resection.
This verdict resolves only the Pattersons’ claims; it does not directly decide or aggregate outcomes for other plaintiffs, though it’s expected to influence how the remaining cases are valued and negotiated going forward.

After nearly eight hours of second-stage labor with a deteriorating fetal heart rate strip, the OB/GYN opted for a vacuum-assisted delivery rather than an emergent C-section. The delivery involved a prolonged, complicated shoulder dystocia. The infant suffered severe neonatal encephalopathy and died roughly three hours after birth; an autopsy attributed the cause of death to metabolic acidosis from the prolonged delivery. The mother sustained a rectovaginal fistula from the vacuum extraction, leading to permanent fecal incontinence after an unsuccessful surgical repair.
Plaintiffs alleged the physician breached the standard of care by delaying cesarean delivery and over-extending vacuum use, and that hospital nursing staff failed to escalate fetal monitoring concerns and administered Pitocin despite contraindication.
