When mass tort Multi-District Litigation (MDL) is organized by the court, a Plaintiff Steering Committee (PSC) is organized and attorney members are appointed to lead the common interests of all MDL plaintiffs. Although the responsibilities vary slightly by MDL, the purpose of the PSC remains the same.
PSC attorneys are appointed based on their skill, knowledge of the particular MDL facts and history, represented clients, and ability to perform the necessary common benefit work. Such work includes: gathering evidence, documents, records, taking depositions, identifying and interviewing witnesses, meeting with experts, and drafting briefs that will be used for the common benefit of all plaintiffs affected by that particular MDL.
Attorneys serving on a PSC are at the front lines of that litigation, with the best and most accurate information. They also have a direct seat in the courtroom or at the negotiating table. Therefore, only the very strongest and best qualified attorneys are selected for these prestigious positions.
