$88 Million Verdict in First Covidien Hernia Mesh Bellwether Trial

Updated August 4, 2026

A federal jury in Boston just delivered a major verdict against Covidien, now part of Medtronic. On August 4, 2026, jurors awarded $88 million to Alabama plaintiff Larry Patterson and his wife in the first bellwether trial over Covidien Symbotex hernia mesh.

What Happened

Patterson’s mesh implant failed when its porcine collagen barrier broke down too fast. The exposed polyester mesh then adhered to his bowel, causing a bowel obstruction that required major reconstructive surgery.

The jury found Covidien failed to warn patients about these risks. No punitive damages were awarded, and the jury did not find fraud.

The Numbers

  • $88 million in compensatory damages
  • First bellwether trial out of 10,000+ pending Covidien hernia mesh cases nationwide
  • Zero punitive damages, no fraud finding

Why This Verdict Matters

Bellwether trials are test cases. They don’t decide outcomes for other plaintiffs directly, but they shape everything that happens next: settlement talks, case valuations, and how much risk each side is willing to carry into future trials.

An $88 million win in the very first trial sends a strong signal. It puts pressure on Medtronic heading into settlement negotiations, even though the company has already said it will seek post-trial relief and plans to appeal.
